all artwork and media created by me (@triphalli) is subject to copyright protection under law. i retain intellectual property rights and / or artist rights over all of my works. copyright infringement upon my works will be met with legal action. claiming credit, artwork ownership, or copyright over my work is strictly prohibited. i reserve the right to make changes to these terms of service at any time, which will be effective immediately upon posting the updated terms.
i do not allow: the commercial use of my characters or artwork; the transformation of my artwork in any way without permission; erasing / cropping out my watermark in any way; tracing over my artwork without permission; the use of my brand or characters to impersonate me, for any reason. unauthorized use of my works will be confronted either personally or legally, depending on the severity of the transgression.
MY ARTWORK MAY NOT BE USED FOR AI ART GENERATION, NFTS, CRYPTOCURRENCY, OR ANY BLOCKCHAIN-RELATED TECHNOLOGY.
no depictions of copyrighted or trademarked brand names, merchandise, logos, and other media in my artwork are intended as copyright infringement, commercial use, implication of ownership, or slander. appropriate and creative measures are taken to avoid copyright infringement on others’ work and to creatively transform said work as necessary for fair use. depictions of copyrighted work within my artwork is intended as a means to positively engage with said work, such as with fanart. the sale of artwork containing copyrighted work is not intended to infringe upon or damage the market for or value of the copyrighted work.permissions for any artwork commissioned or won from raffles
1) i retain artist ownership rights over all commissioned / won artwork. i reserve the right to freely use this artwork on my profile, in portfolios, and to advertise my commissions.
2) you can ask for a commission to remain anonymous or private (not posted anywhere online). however, depending on the complexity of the artwork, i may ask for up to a 10% upcharge for keeping the artwork off social media.
3) no artworks commissioned / won will be used to create any merchandise or be resold / redistributed. i will not claim ownership of any characters i do not own.
4) clients can use any artwork commissioned / won for their own personal use. this includes but is not limited to: profile images and headers, personal prints, displays in online galleries (e.g., toyhou.se).
5) payments must be made over paypal or kofi. feel free to reach out about alternatives, but chances are that i won't be able to receive payment that way.
6) commercial use of any commissioned / won artwork is not permitted without permission from me. if permission is granted, i will require credit and a negotiable cut of any money earned from my artwork. this includes but is not limited to: the use of artwork in branding and advertising; the sale of my artwork; the use of my artwork as stream graphics where the streamer is collecting revenue.
7) all commissioned / won artwork must be credited to me. you can ask how to correctly credit me depending on what the use is.
8) i require payment upfront before any work is done. payment plans can be discussed for anything over 100 dollars. artworks will be completed within a month of the payment being sent, and it will be communicated if i need more time for any reason. discounts and refunds due to an extension of time are not applicable unless i fully cancel the commission.
9) i will not draw sexual depictions of minors (both cub and human), beastiality, exposed scat, hateful symbols, or necrophilia. i may be adverse to drawing some other things, and i have the right to refuse any commission.
